Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and KM BRANDS LLC ("Company," "we," "us," "our"), the owner and operator of the Spin for Din mobile application and the spinfordin.com website (together, the "Service"). By creating an account, downloading, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to purchase a subscription or participate in the Refer & Earn program. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

3. The Service

Spin for Din helps you decide what to cook by generating AI-powered recipe suggestions based on the ingredients, dietary preferences, allergies, and filters you provide. Features include the recipe spin wheel, manual ingredient entry, AI kitchen photo scanning, barcode scanning, family groups with dinner voting, favorites and history, grocery lists, nutrition information, and Chef (an AI cooking assistant).

4. AI-Generated Content Disclaimer

Recipes, ingredient detections, nutrition estimates, and Chef responses are generated by artificial intelligence and are provided for informational purposes only. AI-generated content may contain errors or omissions.

  • Allergies and dietary needs: While the Service filters recipes based on the allergies and dietary preferences you provide, you must always independently verify that every ingredient is safe for you and your family before purchasing, preparing, or consuming any food. We do not guarantee that AI-generated recipes are free of any allergen.
  • Not medical or nutritional advice: Nutrition information is estimated (in part using public USDA data) and may be inaccurate. The Service does not provide medical, dietary, or health advice. Consult a qualified professional for medical or nutritional guidance.
  • Food safety: You are solely responsible for safe food handling, storage, and cooking temperatures.

5. Subscriptions and Billing

Spin for Din Premium is an optional auto-renewing subscription available monthly ($7.99/month) or annually ($64.99/year). Prices may vary by region and may change with notice as required by the App Store.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
  • Manage or cancel anytime in Settings → Apple Account → Subscriptions on your device. Cancelation takes effect at the end of the current billing period; you keep access until then.
  • All purchases are processed by Apple. Refund requests are handled by Apple under Apple's terms at reportaproblem.apple.com.
  • Premium features (including weekly spin allowances) are described in the app and may be adjusted over time. Usage allowances, including the number of spins per week, are subject to fair-use limits and may change.

6. Refer & Earn Program

The Refer & Earn program allows Premium subscribers to earn cash rewards for referring new paying members. Participation and reward eligibility require an active Spin for Din Premium subscription; free accounts do not earn rewards. The program is governed by the separate Referral Program Terms & Conditions, which are incorporated into these Terms by reference. The Company may modify, suspend, or terminate the program at any time.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of App Store policies;
  • Attempt to reverse engineer, scrape, or extract the Service's underlying models, prompts, or data;
  • Circumvent usage limits, spin allowances, subscription gating, or referral rules;
  • Create fake, duplicate, or automated accounts;
  • Upload content that is unlawful, infringing, harmful, or that you do not have the right to share;
  • Interfere with or disrupt the Service, its servers, or other users.

8. User Content

You may submit content to the Service, such as kitchen photos, ingredient lists, preferences, family group information, and messages to Chef ("User Content"). You retain ownership of your User Content. You grant the Company a limited, worldwide, non-exclusive license to host, process, and use your User Content solely to operate and improve the Service (for example, sending kitchen photos to our AI provider to detect ingredients). You represent that you have the rights to any content you submit.

9. Family Groups

Family group creators can invite members and manage shared group data (member names, dietary preferences, allergies, and dinner votes). Only invite people you know, and only add information about others (including children) with appropriate consent. The group creator is responsible for the accuracy of member information used in recipe generation.

10. Intellectual Property

The Service, including its software, design, branding, and content (excluding your User Content), is owned by KM BRANDS LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. "Spin for Din" and associated logos are trademarks of KM BRANDS LLC.

11. Third-Party Services

The Service relies on third-party providers, including Apple (payments), RevenueCat (subscription management), Supabase (accounts and data storage), AI model providers (recipe generation and photo analysis), Google Places (restaurant suggestions), and USDA FoodData Central (nutrition data). Your use of the Service is also subject to any applicable third-party terms. We are not responsible for third-party services.

12. Termination

You may stop using the Service and delete your account at any time from Profile → Settings. We may suspend or terminate your access at any time for violation of these Terms, suspected fraud, or as required by law. Upon termination, your license to use the Service ends. Sections that by their nature should survive (including Sections 4, 10, 13, 14, 15, and 16) survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SAFE FOR YOUR SPECIFIC DIETARY NEEDS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KM BRANDS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless KM BRANDS LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

16. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which KM BRANDS LLC is organized, without regard to conflict-of-law principles. Any dispute shall be resolved on an individual basis; you waive any right to participate in a class action to the fullest extent permitted by law.

17. Apple-Specific Terms

These Terms are between you and KM BRANDS LLC, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any product warranties or claims. Apple is a third-party beneficiary of these Terms and may enforce them against you. In-app purchases are subject to Apple's standard EULA and payment terms.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or the website, and the "Last updated" date will be revised. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
