1. Acceptance of Terms

By downloading, installing, or using the Spin for Din application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Spin for Din is a meal suggestion application that uses artificial intelligence to generate recipe ideas based on ingredients you provide. The App may include features such as ingredient management, kitchen scanning, recipe generation, dietary preference filtering, family group management, and grocery list creation. The App is provided on an "as-is" and "as-available" basis.

3. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Accounts & Data

The App stores your preferences, ingredients, and recipe history locally on your device. You are responsible for maintaining the confidentiality of any data stored on your device. We are not responsible for any loss of data due to device failure, app deletion, or any other cause. Family group features may transmit limited data (such as invite codes, member names, and dietary preferences) to facilitate shared functionality.

5. AI-Generated Content Disclaimer

Recipes, nutritional information, ingredient suggestions, and all other content generated by the App's AI features are provided for informational and entertainment purposes only. This content is generated by third-party artificial intelligence services and may contain errors, inaccuracies, or omissions.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• AI-generated recipes may contain ingredients that could cause allergic reactions, food intolerances, or other adverse health effects, even when allergy filters are enabled.
• Nutritional information (calories, macros, etc.) is estimated and should not be relied upon for medical dietary planning.
• Cooking instructions may be incomplete or inaccurate. Always use your own judgment regarding food safety, cooking temperatures, and preparation methods.
• The App does NOT guarantee the safety, accuracy, or suitability of any recipe for any individual.
• Allergy and dietary filters are applied on a best-effort basis and are NOT a substitute for reading ingredient labels or consulting with a medical professional.

6. Food Safety & Health Warning

SPIN FOR DIN IS NOT A MEDICAL OR NUTRITIONAL ADVISORY SERVICE. The App does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider or registered dietitian before making dietary changes, especially if you have food allergies, intolerances, or medical conditions.

You are solely responsible for ensuring that any recipe you prepare is safe for you and anyone you serve. This includes but is not limited to verifying ingredients for allergens, ensuring proper food handling and cooking temperatures, and confirming suitability for any dietary restrictions.

WE SHALL NOT BE LIABLE FOR ANY ALLERGIC REACTION, ILLNESS, INJURY, OR DEATH RESULTING FROM THE PREPARATION OR CONSUMPTION OF ANY RECIPE GENERATED BY THE APP.

7. Intellectual Property

The App, including its design, code, graphics, logos, and interface, is the intellectual property of the Spin for Din team and is protected by copyright and other intellectual property laws. AI-generated recipes are provided for your personal use. You may share recipes with others but may not commercially redistribute, sell, or publish collections of AI-generated recipes from the App without prior written consent.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Interfere with or disrupt the App's functionality or the servers and networks connected to the App.
• Use automated systems, bots, or scripts to access or interact with the App.
• Attempt to bypass any security features or access controls of the App.
• Use the App to transmit any harmful, offensive, or illegal content through family group or sharing features.
• Resell, sublicense, or commercially exploit the App or its content without authorization.

9. Third-Party Services

The App may utilize third-party services including but not limited to AI language models (for recipe generation), food databases (for ingredient data), and cloud services (for family group functionality). These third-party services have their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of the App constitutes acceptance of any applicable third-party terms.

10. Privacy & Data Collection

We respect your privacy. The App primarily stores data locally on your device. When you use AI-powered features (recipe generation, kitchen scanning), the ingredients and preferences you provide may be sent to third-party AI services for processing. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPIN FOR DIN, ITS DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App.
• Any recipes, nutritional information, or suggestions provided by the App.
• Any allergic reaction, illness, injury, or adverse health effect resulting from food prepared using the App's suggestions.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content.
• Any other matter relating to the App.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS LESS.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, timely, secure, or error-free.
• The results obtained from the App will be accurate or reliable.
• Any recipes will be safe, suitable, or appropriate for any individual.
• Allergy or dietary filters will catch all potential allergens or unsuitable ingredients.
• Nutritional information will be accurate.

13. Indemnification

You agree to indemnify, defend, and hold harmless Spin for Din, its developers, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the App, your violation of these Terms, or your violation of any rights of any third party.

14. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Children's Privacy

The App is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. The "Kids Menu" feature is designed to generate kid-friendly recipes for parents and guardians to prepare — it is not intended for use by children directly. If you believe a child under 13 has provided personal information through the App, please contact us so we can take appropriate action.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms constitute the entire agreement between you and Spin for Din regarding the use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
